Terms & Conditions
Last updated: October 21, 2026
These terms describe Tovrino Chimney’s scheduling and referral role and the separate responsibilities of independent service providers.
1. Acceptance of Terms
These Terms apply to the Tovrino Chimney website and its chimney inspection scheduling, estimate-request and referral services in New Jersey, eastern Pennsylvania and Delaware. Tovrino Chimney is the brand used for the website and request-coordination service. Contact details appear in Section 25.
Submitting a callback request asks us to respond; it does not create an on-site service contract, confirm an appointment, authorize payment or approve additional work. Any separate service agreement must identify the actual service provider.
These Terms describe the website and scheduling relationship. They do not replace mandatory transaction disclosures, cancellation notices, written contracts or a service provider’s obligations. Applicable law determines whether and how any provision becomes binding.
2. Tovrino Chimney’s Role
Tovrino Chimney provides marketing, request handling, scheduling support, and referrals for chimney inspections in New Jersey, eastern Pennsylvania, and Delaware.
On-site work is performed by an independent service provider, not by the website scheduling service. The provider assigned to your request agrees the field-service scope with you, performs the work, and collects payment directly.
We help communicate your request and coordinate availability. Before you accept an appointment, the provider’s identity, inspection scope, access limitations, total price, and applicable terms should be confirmed. This description does not determine or remove any responsibility that applicable law assigns to Tovrino Chimney or a provider.
3. Independent Service Providers
Field services arranged through Tovrino Chimney are performed by independently owned and operated Service Providers.
Service Providers are separate businesses and are not employees, agents, partners, joint venturers, franchisees, or legal representatives of Tovrino Chimney.
Tovrino Chimney does not control a Service Provider’s day-to-day field operations, personnel, professional judgment, service methods, means, tools, equipment, recommendations, pricing decisions, or manner of performing field services.
Service Providers do not have authority to make contracts, warranties, guarantees, promises, representations, or commitments on behalf of Tovrino Chimney unless Tovrino Chimney expressly authorizes such authority in writing.
Any agreement concerning the actual performance of field services, including field-service scope, pricing, payment, workmanship, warranties, guarantees, refunds, and service results, is between the customer and the independent Service Provider performing those services.
4. Appointment and Referral Model
A request, lead, referral, advertisement, telephone call, estimate request, or appointment generated or coordinated through Tovrino Chimney is intended to help connect a customer with an independent Service Provider.
The appointment itself does not create a contract for Tovrino Chimney to perform field work.
The Service Provider is independently responsible for discussing with the customer any proposed field service, final scope, final price, required customer authorization, and any terms applicable to the field service before performing work.
If the customer accepts a Service Provider’s proposed work, the resulting field-service transaction is between the customer and that Service Provider.
5. Licensing and Regulated Work
Each Service Provider is independently responsible for determining and complying with any licensing, certification, registration, permitting, insurance, or other legal requirements applicable to the field services it offers or performs.
A Service Provider must not perform work requiring professional authorization unless the person or entity performing that work is legally authorized to do so.
Tovrino Chimney does not lend, provide, sponsor, transfer, or authorize the use of any contractor or professional license.
Nothing in a Tovrino Chimney advertisement, customer communication, referral, or appointment authorizes Tovrino Chimney or any Service Provider to perform regulated work in violation of applicable law.
If a Service Provider determines that requested or recommended work requires a license, permit, certification, registration, or other professional authorization, responsibility for legally addressing that proposed work remains with the Service Provider and the customer involved in that field-service transaction.
6. Service Provider Responsibilities
Each Service Provider is independently responsible for the field services it provides, including, as applicable:
Its personnel and subcontractors;
On-site evaluations and professional judgment;
Descriptions and explanations of proposed services;
Final scope of work;
Final pricing;
Customer authorization;
Workmanship and service quality;
Tools, equipment, and materials;
Safety practices;
Compliance with applicable laws;
Required licenses, certifications, permits, registrations, and insurance;
Collection of customer payment;
Invoices and receipts;
Any warranty or guarantee offered by the Service Provider;
Refunds or adjustments relating to the Service Provider’s work; and
Conduct at the customer’s property.
Tovrino Chimney does not assume these field-service responsibilities merely because it advertised a service category, received a customer request, coordinated an appointment, or later assisted with customer communication.
7. Estimates, Advertised Prices and Promotions
The advertised $49 offer is for the chimney inspection scope expressly confirmed before the appointment. It is not advertised as a starting price for that agreed inspection. Confirm what will be inspected, access limitations, the provider’s identity, the total payable price and any applicable taxes before accepting the appointment.
An estimate request and the initial callback are free. An on-site inspection is not free. A final estimate may require an inspection; any paid visit must be agreed in advance. A free estimate request does not require you to book an inspection.
Cleaning, repairs, parts, expanded inspection scopes and other services are outside the $49 inspection unless expressly included in the confirmed scope. No undisclosed mandatory charge or additional service is authorized by submitting a form. Any separate charge requires advance disclosure and your approval.
You may finish after the agreed inspection. Declining additional services does not increase the agreed inspection price. If the advertised inspection is unavailable for your property, this must be explained before you agree to a different offer. Misleading discounts, bait-and-switch practices and pressure to buy unapproved services are not authorized.
8. Customer Authorization and Final Pricing
Customers should review and understand the Service Provider’s proposed scope and final price before authorizing field work.
A customer is not required by Tovrino Chimney to purchase additional services recommended by a Service Provider.
Authorization for work beyond the originally requested service should be obtained directly by the Service Provider before that additional work is performed.
Questions concerning a Service Provider’s final price, additional work, warranty, or payment terms should be addressed directly with the Service Provider before authorization.
9. Additional Services Proposed by a Service Provider
Tovrino Chimney coordinates appointments based on the service request submitted by the customer.
A Service Provider may independently identify or propose additional services after arriving at the customer’s property.
Any additional service independently proposed by a Service Provider, including chimney cleaning, masonry repair, liner work, cap replacement, installation, or other work beyond the customer’s original Tovrino Chimney service request, is not offered, sold, contracted for, approved, supervised, performed, or guaranteed by Tovrino Chimney merely because the original customer appointment was generated or scheduled through Tovrino Chimney.
If a Service Provider independently proposes additional work, that Service Provider is responsible for determining whether the proposed work requires licensing, certification, registration, permitting, insurance, or other legal authorization and for complying with all applicable requirements.
Any agreement between a customer and a Service Provider concerning independently proposed additional work, including its scope, price, authorization, payment, performance, warranty, or refund terms, is between the customer and that Service Provider.
Tovrino Chimney does not authorize a Service Provider to use a Tovrino Chimney appointment, lead, referral, advertisement, or customer relationship as authority to perform work that the Service Provider is not legally authorized to perform.
Tovrino Chimney does not authorize Service Providers to represent that Tovrino Chimney requested, approved, recommended, guaranteed, or required additional work when Tovrino Chimney did not do so.
10. Payments and Referral Compensation
This website does not take payment for submitting a request. Payment for field services is made directly to the independent provider, who supplies its invoice or receipt and any required transaction documents.
The advertised $49 inspection is subject to the agreed inspection scope described in Section 7. Additional work or charges require separate advance disclosure and your approval.
Tovrino Chimney may receive compensation from independent providers for marketing, referral, scheduling, or customer-support services. Compensation does not by itself decide the parties’ legal relationship; actual conduct and applicable law control.
11. No Technical Advice or Diagnosis by Tovrino Chimney
Tovrino Chimney communications with customers are primarily for marketing, scheduling, referral, appointment coordination, and customer-support purposes.
Tovrino Chimney does not perform on-site inspections and does not provide professional chimney diagnoses, engineering advice, technical evaluations, or professional opinions concerning the condition of a customer’s equipment or property.
Information a customer provides to Tovrino Chimney concerning symptoms, property conditions, chimneys, fireplaces, or requested inspections may be used to understand the customer’s request and coordinate an appointment.
Any on-site technical evaluation, professional recommendation, service recommendation, or diagnosis is the responsibility of the independent Service Provider providing that evaluation or recommendation.
12. No Guarantee of Service Provider Performance
Tovrino Chimney does not guarantee the workmanship, professional judgment, recommendations, representations, availability, arrival time, completion time, final pricing, warranties, guarantees, or results of an independent Service Provider.
Each Service Provider remains independently responsible for the services it performs and for maintaining any license, permit, certification, registration, insurance, or other authorization required for its activities.
Property conditions, accessibility, system conditions, maintenance history, construction, environmental conditions, and other circumstances may affect the services offered or results achieved by a Service Provider.
Nothing in these Terms limits responsibility that Tovrino Chimney may have for its own conduct where applicable law does not permit that responsibility to be waived or limited.
13. Service Provider Conduct
Tovrino Chimney does not authorize deceptive, fraudulent, coercive, unsafe, unauthorized, unlicensed, or otherwise unlawful conduct by a Service Provider.
A Service Provider may not represent itself as a Tovrino Chimney employee or field technician when it is not one.
A Service Provider may not represent that Tovrino Chimney performed, supervised, warranted, or guaranteed the Service Provider’s field work when Tovrino Chimney did not do so.
Tovrino Chimney may choose not to coordinate future appointments with a Service Provider based on legitimate business, customer-service, safety, fraud-prevention, compliance, or quality concerns.
Such a decision does not mean Tovrino Chimney controlled or supervised the Service Provider’s prior field work.
14. Customer Follow-Up and Customer Support
Tovrino Chimney may contact customers before or after an appointment for scheduling, appointment confirmation, customer support, quality assurance, fraud prevention, complaint handling, dispute communication, or customer feedback.
Tovrino Chimney may ask whether a Service Provider arrived, whether the requested service occurred, whether additional work was proposed, whether a problem occurred, or whether the customer was satisfied.
Customer follow-up, complaint handling, or customer-support assistance by Tovrino Chimney does not constitute supervision or control of the Service Provider’s field operations.
Tovrino Chimney may voluntarily assist a customer and Service Provider in communicating about a concern.
Providing such assistance does not mean Tovrino Chimney assumes responsibility for the Service Provider’s work, promises a particular outcome, or becomes a party to the Service Provider’s field-service transaction.
15. Complaints, Property Damage and Field-Service Disputes
Complaints concerning workmanship, field-service pricing, warranties, refunds, billing, property damage, bodily injury, incomplete work, service results, or other matters arising from services performed by an independent Service Provider should be directed to the Service Provider responsible for the field service.
Tovrino Chimney may assist with communication at its discretion but does not thereby assume responsibility for the Service Provider’s field work or conduct.
Nothing in this section limits any non-waivable right or remedy available to a customer under applicable law.
16. Communications and Appointment Information
Submitting a service form requests a call from Tovrino Chimney, or the independent provider handling your request, about your selected inspection or estimate. Relevant contact, location, service, and appointment details may be shared with providers involved in responding to that request, as explained in our Privacy Policy.
A service request does not provide consent to unrelated marketing, prerecorded promotional calls, recurring automated marketing texts, or call recording. Separate consent and disclosures are required where applicable law requires them.
To withdraw a request or ask that nonessential contact stop, email tovrino100@gmail.com. Necessary communications about an existing service transaction or legal obligation may still be appropriate. A privacy request is handled for privacy administration, not as a request for an inspection.
17. Telephone Calls and Call Recording
A telephone link opens your device’s calling application. Clicking it, using this website, or submitting a service form is not consent to recording a call.
Any call recording or monitoring requires the separate notice and consent required by the laws that apply to the participants and the call. A provision in these Terms does not replace that process.
18. Website and Advertising Information
Availability is confirmed for your address before booking. The $49 offer and any material restrictions must be explained clearly; these Terms do not permit an undisclosed mandatory fee or a change to an agreed price without your approval.
A general description of possible services does not include those services in the $49 inspection. No image or statement on this website is proof of a provider’s licence, registration, insurance, certification, or particular inspection scope.
Applicable licensing, registration, consumer-protection, and advertising requirements depend on the activity and location. The coordination model described here is not a declaration that Tovrino Chimney or a provider is exempt from those requirements.
19. Limitation of Liability
The allocation of field-service responsibilities in these Terms describes the intended business relationship. It does not decide whether Tovrino Chimney or a provider is legally responsible in a particular case; actual conduct and applicable law control.
Tovrino Chimney does not offer a separate workmanship warranty for an independent provider’s services merely by arranging an appointment. This does not eliminate a warranty actually given by us, a statutory warranty, a remedy for our own representations or any responsibility the law imposes on us.
These Terms do not exclude or cap liability for Tovrino Chimney’s own negligence, fraud, deceptive practices, willful misconduct, privacy violations or other actionable conduct. They do not waive available statutory damages, attorney fees, bodily-injury or property-damage claims, or other legally protected remedies. No blanket release of a provider or Tovrino Chimney is requested.
For New Jersey consumers in particular, the statements about independence, service limitations and absence of a separate workmanship warranty do not limit rights under the New Jersey Consumer Fraud Act or the Truth-in-Consumer Contract, Warranty and Notice Act. These Terms contain no exclusion of consequential or punitive damages that those laws make recoverable.
20. No Waiver of Consumer Rights
Nothing in these Terms is intended to waive any consumer right or remedy that applicable federal, New Jersey, Pennsylvania, Delaware, or other mandatory law does not permit a consumer to waive.
If a provision of these Terms conflicts with a mandatory legal requirement, the mandatory legal requirement controls to the extent of that conflict.
21. Independent Provider Relationship
These Terms describe a referral and scheduling arrangement with independent service providers. A referral or payment of a referral fee does not by itself establish employment, partnership, agency, or supervision.
A provider may not promise that Tovrino Chimney performs, warrants, or guarantees its field work without actual authorization. The legal relationship and each party’s responsibilities are determined by their actual conduct, agreements, and applicable law; a website label does not override them.
22. Governing Law and Venue
Applicable federal law and any mandatory state or local law govern the respective rights of customers, Tovrino Chimney, and independent Service Providers. Nothing in these Terms displaces mandatory protections that apply where a customer resides or services are provided, including in New Jersey, Pennsylvania, or Delaware.
Any court proceeding must be brought in a court of competent jurisdiction as required or permitted by applicable law. These Terms do not require a customer to waive a legally protected choice of forum.
A separate dispute solely between a customer and an independent Service Provider concerning that provider’s field services is governed by their agreement and applicable law.
23. Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision shall be interpreted or limited to the minimum extent necessary to make it enforceable where permitted by law.
The remaining provisions shall continue in full force and effect.
24. Changes to These Terms
Tovrino Chimney may update these Terms from time to time to reflect changes in its Website, business operations, legal requirements, or practices.
Changes apply prospectively from the time updated Terms are posted or otherwise become effective, except where applicable law requires different treatment.
The Last Updated date at the top of these Terms may be revised when material changes are made.
25. Contact Information
Website brand: Tovrino Chimney
Regional telephone: (551) 261-7287
Email for questions, privacy requests, appeals, and accessibility assistance: tovrino100@gmail.com
For privacy choices and requests, use our Privacy Policy contact instructions. Do not send payment-card details, passwords, Social Security numbers, or identity documents through an ordinary form or email.
The assigned provider’s service agreement and invoice should identify that provider and its own contact information.
26. Cancellations, Rescheduling and Refunds
A callback request may be withdrawn without charge. No website payment, subscription or recurring charge is created. Contact us and, for a confirmed visit, the identified provider promptly if you need to cancel or reschedule. These Terms do not create a cancellation or no-show fee.
A provider must disclose any lawful cancellation/payment terms before you accept its service agreement and supply required cancellation notices. Mandatory cooling-off rights take priority. The federal Cooling-Off Rule and state home-solicitation or home-improvement rules can apply to qualifying transactions; this website is not a substitute for the transaction-specific notice.
Where Pennsylvania’s Home Improvement Consumer Protection Act applies, its cancellation rights and permitted methods of notice are preserved. New Jersey and Delaware consumers retain applicable state cancellation rights. Do not assume that every inspection falls within the same statutory category or that requesting an early appointment waives a right.
Refunds for provider payments should be requested from the payee. You may also report a concern about our own representations or coordination to us. Nothing makes provider contact your exclusive remedy or prevents a complaint, lawful chargeback or court claim.
27. State Consumer Protections and Disputes
New Jersey: the Consumer Fraud Act and Truth-in-Consumer Contract, Warranty and Notice Act remain applicable where their requirements are met. Pennsylvania: the Unfair Trade Practices and Consumer Protection Law and, for covered transactions, the Home Improvement Consumer Protection Act remain applicable. Delaware: the Consumer Fraud Act and applicable home-solicitation and telemarketing protections remain applicable.
No arbitration requirement, class-action waiver, jury-trial waiver, shortened statutory limitation period or exclusive out-of-state forum is imposed by these Terms. You may use an available small-claims court or contact the appropriate state consumer-protection agency. Informal discussion is encouraged but is not a prerequisite that delays legal deadlines.
Any statutory registration, license, insurance, permit or written-contract requirement depends on the actual activity and location, not the label used on this website. These Terms do not declare any activity exempt or transfer away a legal duty imposed on Tovrino Chimney.
28. Access, Inspection Limits and Safety
The person booking must be an adult authorized to arrange access to the property. Coordinate safe access, pets, occupants and any access restrictions with the provider. The provider must explain inaccessible areas and the inspection scope; an inspection is not a promise to identify every hidden defect or a guarantee of future performance.
The website is not an emergency service or a technical safety certification. In an immediate emergency, leave the affected area and contact emergency services. Do not use a callback form for urgent assistance.
29. Website Use, Content and Third-Party Links
Do not submit requests using another person’s details without authority, misuse the forms, disrupt the site or attempt unauthorized access. We may restrict abusive use while preserving legitimate privacy requests and consumer rights.
Website branding, text and visual assets may not be reused in a way that infringes applicable intellectual-property rights. Illustrative imagery does not establish that a pictured property is a customer property or that a depicted person is our employee. No image is a testimonial.
An external link does not make a third party part of this business. Third-party websites and independent provider agreements have their own terms. This website does not apply another business’s privacy policy or service terms to you.
